Telio data protection notices according to Article 13 & 14 DSGVO for applicants

I. General
 If you apply via one of our websites, then this data protection notice applies.
 We are pleased that you are interested in us and have applied for a position with us. In the following, we would like to provide you with information on the processing of your personal data in connection with your application.
 
II. Responsible party
 The responsible party for the processing of your personal data within the meaning of the DSGVO is Telio Management GmbH, Gasstraße 18,   Haus 3, 22761 Hamburg, Germany.
 You can request further information about the company and the persons authorized to represent it from us at any time.
 
If you wish to  object to the processing of your data by us in accordance with this data  protection notice, either in its entirety or for individual measures, you can  address your objection to the above-mentioned responsible body. You can copy  this data protection notice at any time.
      
III. Which of your data do we process? And for what purposes?
 We process your data for the purpose of carrying out the application process.
 We process the personal data that we receive from you ourselves as part of your application. This is the data that you provide to us as part of your application, in particular by submitting your application documents and the information you provide during interviews. We also visit profiles of applicants on Xing and LinkedIn or other professionally oriented social networks, if such are available, and also download the resumes in the corresponding networks, if possible. We do not visit profiles on private social networks.
 Furthermore, it is possible that we receive data from recruiters to whom you have given your application documents and whom they suggest to us as candidates for a position.
 If you contact us (e.g. by contact form, letter or e-mail), we store your information for processing the request and in case follow-up questions arise. We only store and use other personal data if you consent to this or if this is legally permissible without special consent.
 
IV. On what legal basis is the data processed and how long is the data stored?
We process your  personal data in accordance with the provisions of the DSGVO and the German  Federal Data Protection Act (BDSG), insofar as this is necessary for the decision on the establishment of an employment relationship with us. The legal  basis for this is Article 88 DSGVO in conjunction with Section 26 BDSG-neu and,  if applicable, in conjunction with the following legal bases:

The legal basis  for processing your personal data in this application process is Art. 6 (1)  lit. b) DSGVO for the implementation of pre-contractual measures, which are carried out at the request of applicants or requests from placement agencies on  behalf of applicants.

Furthermore, we  may process personal data from you if this is necessary for the fulfillment of  legal obligations (Art. 6 para. 1 lit. c DSGVO). Should the data be required after the conclusion of the placement procedure, if necessary, for legal  prosecution, and for the traceability of claims of placement agencies, data  processing may take place on the basis of the requirements of Art. 6 DSGVO, in  particular for the exercise of legitimate interests according to Art. 6 para. 1  lit. f) DSGVO. Our interest then consists in the assertion or defense of  claims. The legitimate interest is, for example, a duty to provide evidence in  proceedings under the General Equal Treatment Act (AGG) or a claim for payment  by a placement agency.

If you give us  express consent to process personal data for further processing of the data for  future job advertisements, this is done on the basis of your consent in accordance with Art. 6 Para. 1 lit. a DSGVO. Consent given can be revoked at  any time, with effect for the future. If an employment relationship arises  between you and us, we may, in accordance with Art. 88 DSGVO in conjunction  with § 26 BDSG-neu, further process the personal data already received from you  for the purposes of the employment relationship, insofar as this is necessary  for the implementation or termination of the employment relationship or for the  exercise or fulfillment of the rights and obligations arising from a law. The  following applies in particular to the application process: If you have not  been selected for the position for which you have applied, we will delete your  data, if you withdraw your application, six months after the withdrawal of your  application and, if we reject you, six months from the date of rejection or, if  you were recommended to us as a candidate by a placement agency and we reject  you, we will delete your data one year from the date of rejection. In the event  that an employment contract is concluded between you and us or one of our Group  companies, your application documents will be included in the personnel file  and stored for at least the duration of the employment relationship.

If and to the  extent that you have given us consent to process data for specific purposes,  for example to actively contact you on our part to offer you further vacancies  with us or one of our Group companies, the processing period will be determined  by the purpose of the consent given. Please refer to the information provided  in connection with the declaration of consent.
 
V. To which recipients is the data passed on?
 Your applicant data will be viewed by the specialist department after receipt of your application. In principle, only those persons within the company have access to your data who require this for the proper conduct of our application process.
 
VI. Where is the data processed?
 The data is processed exclusively in data centers in the European Union.
 
VII. What rights do you have as a data subject affected by the data processing?
 According to the applicable laws, you have various rights regarding your personal data.
 You have the right to information about the personal data we process about you. In the case of a request for information that is not made in writing, we ask for your understanding that we may then require evidence from you that proves that you are the person you claim to be.
Furthermore,  you have a right to rectification or deletion or to restriction of processing,  insofar as you are entitled to this by law.

Furthermore,  you have a right to object to processing within the scope of the law.
The same  applies to a right to data portability.

If you have  given consent, you have the right to revoke consent to the processing of  personal data at any time.

VIII. Automated decision making
 Automated decision-making in an application process does not take place as a matter of principle.
 
IX. Transfer of data to third parties, no data transfer to non-EU countries
 In principle, we only use your personal data within our company. If and to the extent that we involve third parties in the performance of contracts, they will only receive personal data to the extent that the transfer is necessary for the corresponding service. In the event that we outsource certain parts of data processing ("commissioned processing"), we contractually oblige commissioned processors to use personal data only in accordance with the requirements of data protection laws and to ensure the protection of the rights of the data subject. Data transfer to entities or persons outside the EU does not take place and is not planned.

Processing of (personal) data by the operator of the recruitment website

General information

This recruitment website is operated by Personio SE & Co. KG, which offers a human resource and candidate management software solution (https://www.personio.com/legal-notice/). Data transmitted as part of your application will be transferred using TLS encryption and stored in a database. The sole controller of this data within the meaning of article 24 of the GDPR is the enterprise carrying out this online application process. Personio’s role is limited to operating the software and this recruitment website and, in this context, being a processor under article 28 of the GDPR. In this case, the processing by Personio is based on an agreement for the processing of orders between the controller and Personio. In addition, Personio SE & Co. KG processes further data, some of which may be personal data, to provide its services, in particular for operating this recruitment website. We will refer to this in more detail below.

Access logs (“server logs”)

Each access to this recruitment website automatically causes general protocol data, so-called server logs, to be collected. As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. Without this data, it would, in some cases, be technically impossible to deliver or display the contents of the software. In addition, processing this data is absolutely necessary under security aspects, in particular for access, input, transfer, and storage control. Furthermore, this anonymous information can be used for statistical purposes and for optimizing services and technology. In addition, the log files can be checked and analyzed retrospectively when unlawful use of the software is suspected. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. Generally, data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp of the access to the software is collected. The scope of this log process does not exceed the common log scope of any other site on the web. These access logs are stored for a period of up to 7 days. There is no right to object to this.

Error logs

So-called error logs are generated for the purpose of identifying and fixing bugs. This is absolutely necessary to ensure we can react as quickly as possible to possible problems with displaying and implementing content (legitimate interest). As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. When an error message occurs, general data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp upon occurrence of the respective error message and/or specification is collected. These error logs are stored for a period of up to 7 days. There is no right to object to this.

Use of cookies

So-called cookies are used on parts of this recruitment website. They are small text files which are stored on the device with which you access this recruitment website. As a general rule, cookies serve the purpose of ensuring secure access to a website (“absolutely necessary”), implementing certain functionalities such as standard-language settings (“functional”), improving the user experience or the performance of the website (“performance”), or placing targeted advertisements (“marketing”). On this recruitment website, we generally use only cookies that are absolutely necessary, functional or performance-related, in particular for implementing certain default settings such as language, for identifying the job advertising channel, or for analyzing the performance of a job advert via which a user accessed this recruitment website. Personio reserves the right to adjust this data privacy statement at any point in time to ensure that it is in line with the current legal requirements at all times, or in order to accommodate changes in the services offered, for example when new services are introduced.
